Yeah, I noticed that too. The gray metal piece at the bottom is camouflaged with the gray sidewalk. It might help if that metal piece were yellow, but even then, some people will still walk into it. Perhaps several small flags attached to the pole would help.
In the end, we'll have to see what's allowed. There are a gazillion rules governing this kind of stuff.
