I would agree with zathis. There is no way you can negotiate with PA City Hall. I have tried. Just do the work and if you are still upset sell the place and move to a city that is more to your liking.

i have to admit, the CITY OF PRINCE ALBERT seem to pick and choose what battles they want to fight. I just wish they would be consistent and fair with everybody. I just know from experience. Talk about being not knowing what to do. AND knowing what happens when the time comes

talk to your realtor about the issue.It is suppose to be in the home owners disclosure when selling and if they lied about it then you have grounds to go after the previous owner but if they told you about it then it is out of your pocket.

I have done everything possible to recoup the monies to fix the structural damage to my home.
The problem with my situation is that I am exhausted financially by the the professionals who were paid very well who were involved in my case. The professioanls solicited were limited in their contractural obligations due to their involvement with the previous vendor .Defence given to their professioanl associations in I reporting them was that they had to maintain the confidentiality of the knowledge aquired in the contracts fulfilled to the previous vendor. To me this is
similar to a nurse going into a home to do wound care on an individual and not reporting the child abuse that is going on. Long live white collar crime.

So why does the City of Prince Albert not give the person who completed the work identified in the work orders issued by their inspector a phone call. It is not like they do not know who did the work. Talking to this person would confirm when and how the work was done. Does not the Municipality have a responsibility to enforce the National Standard Building Codes against those that break them. No where in the Building Standards act does it read present homeowner it reads owner. Owner is being referred to as the prsent owner when the bylaws were breached Is it not meant to hold a responsible home owner responsible for another's deceit.

Another reason to always have a home inspection done prior to purchasing. Your realtor should have informed you of this. I feel for you!! Good luck with things.

You had the chance to get a home inspection, but decided to save a few hundred dollars. Now you have the choice to either fix it up, pay fines or just give it back to the bank.

When making large, important and expensive decisions, make sure you are informed.

Mist Dog I did have a Home Inspection. I also went back to the home prior to puirchase with the Home Inspector, the Real Estate Agent and a Carpenter to review everything written in the Home inspection Report. I talked to neighbours, real estate agents, asked specific questions related to water seepage and or structural damage. Other contractors were consuled before purchasing. The disclosure statement which was incorporated into the contract and purchase of sale disclosed no known structural problems or known water leakage and or damage. Nor was their any mention of the extensive renovations completed by this owner. Renovations that were not apparent due to the dated decor and recycling of dated materials in renovating which hid any visual cues. I do not understand why the City of Prince Albert does not recieve counsel from the very competent lawyer they have already paid (and are paying?) in the enforcement of their bylaws. Prince Albert City Hall has errored in fining a reponsible home owner for another's deceit. All I would have needed from this previous vendor is the same consumer rights given in purchasing for I to walk away from the sale.

Trisha I did get a home inspector's report. I refer you to my response to Mist Dog which was forwarded for posting...the vendor did not fulfill their end of the bargain in reporting known hidden defects. Where are you receiving the information that I did not get a home inspection report? Could you please forward how you arrived at this decision....or are you assuming same due to having to take off your rose colored glasses in having to accept how vendors are getting away with mortgage fraud while municipal, provincial and federal goverments turn the other way.

Does anyone know what happens to this home owner with summary convictions in the fines to be levied. The city has deep pockets in reaching into the tax dollars paid to them by those who reside and work in this municipality. I cannot see anyone having the money to fight City Hall. I am sure if this homeowner had the money to fight City Hall they would have fixed thier home. This is just so unfair.

I know all the avenues you have taken trying to resolve these issues, and it is a true crime that no one will take responsibility for their (many) hand(s) in not having done this properly to begin with, and for now stepping up and fixing it now and having the guts to step forward and admit their parts in it.

I would think you could sue him then to recoup the costs of repair... to file a claim in small claims court shouldn't be too expensive.

They would likely award you for the costs to repair... but any fines for not fixing before July 1st is likely on you.... I would get on getting that fixed first. Or if possible... ask for an extension.

So tell me something.... could the City of Prince Albert not have filed an interest on the title to the homes of the accused perpatrators of this deceit besides the home owner who uncovered the problem. It has been reported that ample documentation from professionals was submitted to the City of Prince Albert proving the construction methods were completed by the previous vendor. Why does the City of Prince Albert hold this one home owner responsible when clearly others committed the crime in breaching National Standard Building Codes.

The crime being identified here is the breaching of National Standard Building Codes. Codes that have been legislated for municipal goverments to regulate and enforce. Summary convictions and fines are to be levied against those that breach. How can the home owner who discovers the wrongs be the one held accountable. The City of Prince Albert in not holding the individuals responsible that actually committed the acts are helping them get away with the crime. The message being sent by this City's inaction in not addressing same is unsettling.

Just came back from City Hall paid my Property Taxes and Water Bill (ouch that hurt)...Dueling Banjos was playing over the intercom system...for once the City of Prince Albert got it right.

Maxpower guest...estimated costs of repair average $70.000.00 not including the variance. Small claims court maxes out at $25,000.00. By asking for an extension to the time limits given in the work orders issued by the City of Prince Albert to fix same would be accepting of the work orders as being
correct. This is the same advice the provincial goverment gave me and this is the same response given by myself in not appealing the time limits. Why was my issue closed ? I am still being held accountable in the TWO work orders that could have been written as one by the City of Prince Albert . The writing of two seperate work orders doubles the fines and summary convictions in being held accountable for the contraventions discovered in the construction methods employed by the previous vendor. How would you like to live under this stress?

I am begging the previous vendor to come forward and own up to the construction that was completed while under their ownership. I am facing fines in the amount of $10,000.00 a day for the two work orders issued in the construction methods employed. Your silence in not taking responsibility for same is placing me in an impossible position. I am stuck with a home that has no value do to the stressed foundation. Mortgage company will not renew mortgage due to i having to come up with the money to fix to ensure value first. I have to give the home back to the bank therefore presently going through a foreclosure. A $70,000.00 profit was made in the sale of this home and now you have dodged another bullet in not owning up to the summary convictions that should be levied against you.

This post is meant to answer those that have asked if I had a lawyer. Yes a very good lawyer,past president of the law society,has won citizen of the year( City of Prince Albert) and a well respected trial lawyer. A lawyer I did not solicit the services of until all attempts on my own in dealing with the previous vendor( who immediatley lawyered up) failed. A lawyer who had knowledge of the previous vendors renovations before taking me on as a client (No I was never informed of this) A lawyer who has private interests to the well being of the defendant. A lawyer who discharged me the same day in a hand delivered letter for a voice mail message I never left. The voice mail message left by myself was that " i think we have a problem when I start to believe my own lawyer is starving me out." I would like to thank all those citizens in the community who contacted me after this discharge informing me of this lawyers past relationsship and special interests with the defendant. I just hope this online paper has the courage to print this.

Shortly aftert moving into property tore down delapitated garage. City of PA gave me a phone call a few days later asking if i got a demolition permit for same. No I did not ignorance of the bylaws was not an excuse for not obtaining the demolition permit. I was called down to PA City Hall asked how i tore same down ,who was involved and how I ensured safety. I was even asked how I halled away (disposed of) the cement. I was given a firm verbal warning from Prince Albert City Hall not to engage in any demolition or construction without having the acquired permits in place. Why did PA City Hall never issue a work order to the previous home owner who let the garage fall into a delapitated state which posed high safety risks( ie fire risk) while under their ownership. Why and how does this home owner manage to get a free pass in breaching bylaws?

Tell me something...how does someone buy a house that should have been condemmed upon purchasing. Secure professional reports to secure a mortgage and in releasing a hold back in moprtgage funds until the renovations to correct the
structural damage identified in these reports was completed. Answer Duping the Banks . Not one but two mortgages were acquired by the previous vendor who owned this home. A home that should have been condemmened. How does one get away with this. Lives off a false equity that does not exist then sells and pockets the money to start elsewhere. Why is the homeowner who was never made aware of any of the reports previously secured by this vendor,bank and by real estate agents left holding the bag. All who knew are flying under the radar in being held accountable for the fraud committed here. The big question here is did this vendor act alone or were many others involved in pulling this fraud off. Others having a keen knowledge of the law.

Hate to say it, but facing fines of ten grand a day, it would not take very many days for it to be cheaper to lift the house up and replace the foundation. I have seen concrete basements for large houses come in under 30 grand. From what I can remember seeing drining by your place, it is fairly small so the basement would be cheaper, but you would have the cost of demolition and r & r the house.

Trish if you can get me the name of that contractor who lifted a house for under $30,000.00 please post or mail to me. Have paid over $1,500.00 in consultation fees with engineers plus the costs related to estimates. Are you sure the $30,000.00 you are quoting is just for the cost of materials not including labour, permits etc. The renovations completed to this home by the previous vendor that were suppose to correct the structural problems/issues and related water damage, which were not done to National Standard Building Codes ,have made the fix a contractor's nightmare.

I have in hand a letter from Prince Albert City Hall that the " enforcement of the work orders issued shall be held in abeyance until a decision of an Appeal Board has been handed down."
